An osteopathic doctor may diagnose, treat, operate or prescribe medications for any human disease, pain, injury, deformity or other physical or mental condition as can medical doctors; but, osteopaths emphasize the importance of musculoskeletal structure and manipulative therapy in the maintenance and restoration of health. Physician negligence is when a physician has failed to meet the required standards of skill and care. To recover damages, a patient must prove that there was a patient/doctor relationship in which a duty was owed, and that the physician breached that duty resulting in injury and causing damages. The standard of care generally means that a physician's conduct is judged in comparison with that of a similarly trained professional in the same field. Each state has what is called a Statute of limitations which limits the period of time that you have to bring forth a medical negligence suit.
